Essential!!! State Ukraine is to return back all payments that population in the zone ATO stopped receiving in July 2014!

On 16th October Supreme Administrative Court of Ukraine closed the chapter on the action of vulnerable groups of Lugansk of cancel and recognition illegal the ruling of the Cabinet of Ministers of Ukraine dated from 7.11.14 г. №595 concerning freezing of pension payment and other social payments to citizens who did not move from so-called “zone” ATO.

It was adopted the ruling that left the decision of the County administrative court of Kiev with no amendments.

It means that when court’s decision becomes effective in law, all the retired population, children orphans, and single mums, participants of the Great Patriotic War and of CNPP (Chernobyl Nuclear Power Plant), disabled children and other vulnerable population start get their legal payments, and state Ukraine is to return them all payments that they stopped getting since July 2014.

However, it is necessary to understand that there is no real mechanism of payment above and foregoing means. And moreover, Kiev authorities have no desire to establish it.

It is urgent to notice that the necessity of establishment of such mechanism was indicated in the clause 8 of the Minsk Agreements.

11^th February County Administrative court of Kiev with its ruling№ 826/18826/14 recognized illegal actions since the moment when the clause 2 was adopted ‘Temporary financing of budget institutions, fulfillment of social payments to the population and providing of financial support, separate enterprises and organizations of the Donetsk and Lugansk regions’ due to the ruling KMU № 595 dated from 7 November 2014.

2^nd April 2015 the Administrative Court of Appeal of Kiev with its ruling № 826/18826/14 , and it is the first ruling of the trial court was left without amendments, however, appellate complaints of the representative of the Cabinet of Ministers of Ukraine, Financial Ministry of Ukraine was ignored.
